It’s a staple of the investment newsletter industry to “crow” a little when one of our editor’s recommendations proves right. Wrong calls are often downplayed, ignored, and/or forgotten as fast as possible.
But today I have to admit:
I got this one wrong.
It’s turned out to be a major error. And it has dire consequences for your wealth and well-being as an American…

Here’s what I wrote in the September 10 Daily:

From my years in the [Intelligence Community], I can say this: Even the most basic, entry-level intelligence analyst receives extensive training in the proper labeling, transmission, and storage of classified material. Top Secret material is never to leave the confines of the IC’s most secure, encrypted network. The government minces no words: Doing so would earn this same entry-level analyst a one-way ticket to (U.S. penitentiary) Leavenworth… The level of gall, guile, or gross incompetence required to breech these safety protocols is almost inconceivable. That it should happen at the highest levels of the government is disturbing… Bottom line: Hillary Clinton won’t shake this one. Look for her to lose the Democratic presidential nomination. |
I knew Clinton was in trouble when the details of her private, unsecured email server first began to emerge. It was obvious—to anyone who’s ever held a clearance—her actions violated official security protocols and federal law.
FBI Director Jim Comey suggested as much at his July 5 press conference on the matter:

None of these emails should have been on any kind of unclassified system, but their presence is especially concerning because all of these emails were housed on unclassified personal servers not even supported by full-time security staff, like those found at Departments and Agencies of the U.S. Government—or even with a commercial service like Gmail. |
That alone is a clear violation of U.S. law. To wit, 18 United States Code Section 793 (on gathering, transmitting, or losing defense information):

(f) Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer— Shall be fined under this title or imprisoned not more than ten years, or both. |
And yet, despite overwhelming evidence of Clinton’s gross negligence, Comey stated “no reasonable prosecutor” would bring charges against her. He cited Clinton’s lack of harmful intent as the basis for his recommendation.
Too bad intent has nothing to do with gross negligence…
And too bad for Naval Reserve intelligence officer Bryan Nishimura…
According to FBI.gov, the agency charged Nishimura with unauthorized removal and retention of classified material last June… even though “the investigation did not reveal evidence that Nishimura intended to distribute classified information to unauthorized personnel.”
Nishimura was charged and convicted. He received two years’ probation and a $7,500 fine. And his security clearance was stripped for life.
